Who you are agreeing with

Will Gets Jobs is a sole proprietorship operated by Will Moore III in Bowling Green, Kentucky. In these terms, "I," "me" and "Will Gets Jobs" mean that business. "You" means the person or business buying the services.

You agree to these terms when you start a plan, make your first payment, or ask me to begin work, whichever happens first.

What I provide

Two plans. Both are month to month.

• Free Build, $97 per month. Website design and build at no build fee, managed hosting, domain registration and renewal, and edits and updates on request.
• Growth, $497 per month. Everything in Free Build, plus Meta advertising campaign setup, creative, launch and ongoing management.

Edits and updates cover normal business changes such as content, photos, prices, services, hours and announcements. What counts as a normal edit, and when it is carried out, is at my discretion. A full redesign, a new site, an online store, custom software, or a request that amounts to a separate project is quoted separately and only begins once agreed in writing.

Payment and billing

• Your first monthly payment is due before work begins. There is no build fee and no setup fee.
• Your plan renews automatically every month on the same date until you cancel.
• Monthly fees are charged in advance and cover the month ahead.
• If a payment fails, I may pause work and take your site offline until the account is current, with or without notice.
• Prices can change. A change applies from your next billing date. If you do not want to continue at the new price, you can cancel.

Ad spend is yours, not mine

On the Growth plan, the $497 is my management fee. It is not ad spend.

• Your advertising budget is billed by Meta directly to your own payment method, on your own ad account.
• You set the budget and you can change or stop it at any time.
• I never hold, bill, mark up or refund your ad spend. Money you pay Meta is between you and Meta.
• You are responsible for every charge Meta applies to your account, including charges that run while campaigns are live.

No contract, and how to cancel

There is no term commitment. You can cancel any time by calling or texting (270) 239-0997 or by emailing me. I recommend text or email so there is a record.

• Cancel at least 5 days before your renewal date and you will not be billed again.
• Cancel after that and your plan runs to the end of the month you already paid for, then stops.
• Monthly fees already paid are not refunded or prorated. You keep the service for the month you bought.
• If you are on Growth, pause your ad spend in Meta yourself as well. Cancelling with me does not stop Meta from billing you.
• I may end your plan at any time, for any reason or no reason, with or without notice. If I end it with time left on a month you paid for, that portion is refunded.

Your website, and what happens if you leave

Read this section twice. It is the one people assume.

• The site is yours to use while your plan is active, and only while it is active. The plan buys hosting and use, not ownership.
• Your content stays yours. Your logo, photos, text, reviews, customer information and business name belong to you, before, during and after.
• The built site is licensed to you, not sold. The design, code, layout and underlying files remain mine. There is no build fee paying for a transfer of ownership, and none is included in any plan.
• When your plan ends, the site comes down. No copy, export, backup or transfer of the site or its files is included, and none is owed to you after cancellation.
• Domains, hosting accounts and ad accounts set up or managed by me are not transferred as part of any plan. A transfer after cancellation is at my sole discretion, may carry a separate fee, and is subject to the registrar's or platform's own rules.
• If you want to keep the site, the domain or an account running elsewhere, that is a separate arrangement and has to be agreed in writing before you cancel.

What I need from you

• Content, photos, business details and access when I ask. Delays on your side move the timeline.
• The legal right to everything you hand me. If you send me a photo, a logo or copy, you are confirming you own it or have permission to use it.
• Accurate information about your business, your services, your licensing and your pricing.
• Answering your leads. I can make the phone ring and the messages land. I cannot answer them for you, and campaigns live or die on how fast you respond.
• Admin access to your own Meta Business account, page and ad account where the work requires it.

No guarantee of results

This is the honest part, so it gets its own section.

• I do not guarantee any number of leads, calls, messages, jobs, bookings, revenue or cost per lead.
• Screenshots, figures and campaign examples shown on this site are real records of past work. They are history, not a prediction, and they are not a promise of what your campaign will do.
• Results depend on your market, your budget, your pricing, your reputation, the season, your competition and how quickly you answer.
• Advertising results move. A campaign that performs one month can perform differently the next for reasons outside anyone's control.
• Search rankings, reach and placement are controlled by Google and Meta. I do not control them and cannot guarantee them.

Meta, Google and other platforms

Advertising runs on platforms I do not own. Meta can reject an ad, restrict an account, change its rules or change its pricing at any time, without notice and without explaining why. The same is true of Google, your domain registrar and your hosting provider.

Your use of those platforms is governed by their terms, not mine. I am not responsible for a platform's decision, for the time it takes to resolve one, or for income lost in the meantime, and I am not obliged to appeal or resolve it on your behalf.

Showing the work

I may show work I have done for you as an example of what I do. That includes your website, ad creative and performance screenshots, on my own site, in outreach and on social media.

Names, faces, addresses and phone numbers of your customers are blurred before anything is published. If you would rather I did not show your business at all, tell me in writing and I will take it down.

Confidentiality

I will not share your private business information, customer lists or internal numbers with anyone outside the work, except where the law requires it. You agree to do the same with anything I share with you about how I run campaigns.

Limit of liability

Services are provided as is and as available, with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or uninterrupted or error free service. To the fullest extent the law allows:

• My total liability to you for any claim is limited to the fees you paid me in the three months before the claim arose.
• I am not liable for lost profits, lost business, lost data, lost leads, loss of reputation, or indirect or consequential damages of any kind.
• I am not liable for downtime, outages, hacks, platform bans or failures caused by third party services including hosting providers, registrars, Meta and Google.
• Nothing here limits liability that cannot be limited by law, including fraud or willful misconduct.

Indemnity

You agree to cover me against claims, damages and legal costs that come from content you supplied, from claims you asked me to make about your business, from your products or services, or from your breach of these terms or of a platform's rules.

Using this website

This site is provided as is, for information. Prices shown are current but can change. Nothing on this site is a binding offer until we have spoken and you have started a plan. Do not copy, scrape or republish the design, code or content of this site without permission.

Changes to these terms

I may update these terms at any time. The effective date at the top shows the current version, and the version posted here is the one that applies. Continuing your plan means you accept the current version.

Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts serving Warren County, Kentucky, and we both agree to those courts.

Before anyone files anything, we both agree to pick up the phone and try to sort it out directly first.

The rest

These terms, together with what you agreed to when you started your plan, are the whole agreement between us and replace anything said beforehand. If a court finds one part unenforceable, the rest still stands. If I do not enforce something straight away, I have not given up the right to enforce it later. You cannot transfer this agreement to someone else without my written agreement.
